If you have been ordered by the court to pay more than you can afford, you can apply for an amendment on the judgement, this is done by filling out and submitting a Form N245. You can download a copy of this form using the link above.
If your circumstances change whilst paying a CCJ, you can ask the court to look at your present financial position by filling in the N245. It will cost you £30.00 to send this form to the County Court. If paying by cheque, your cheque must clear before the information is taken into account.
If you have received a blue and white Admission form, the CCJ Judgement may not have been entered against you not payment per month made. If you are quick, you can fill out the Admission form before the CCJ is issued and not have to pay the £30.00 court costs for submitting the N245.
If a bailiff is enforcing a CCJ (debt outstanding) you can apply to the County Court by filling in the form N245 - Application to Suspend a Warrant. You can also request a copy of this form from your local County Court.
If the bailiff is also collecting for other debts you must contact the creditors involved and ask them to withdraw the bailiff and make them an offer of payment.
Remember:
- You DO NOT have to let the bailiff into your home.
- Bailiffs can not use force to gain entry to a property. They can only use 'peaceable means'. Walking through an unlocked door or climbing through a unlocked window (as long as there is no damage) is acceptable.
- The bailiff can not take goods that do not belong to the debtor.
